Arizona Tax

Are you considering a move to Arizona? If the answer is yes, you might want to do some research about Arizona taxes. My guess is that some Arizona taxes will be lower than wherever you are moving from, and some taxes will be higher. For instance, many people are unpleasantly surprised by the personal property tax levied against automobiles in Arizona. It is paid along with your vehicle registration. Others are very pleasantly surprised that their real estate taxes might be lower in Arizona. It all depends on your personal situation. Whether the level of taxation in Arizona is a factor in your move or not, it is best to be aware so there are no tax surprises later!

Arizona Taxes

Personal Income Tax
Residents and nonresidents that earn income in Arizona will pay state income tax. To compute your Arizona income tax, you will start with your federal adjusted gross income. Then you will be able to make certain additions and subtractions to arrive at Arizona taxable income. For instance, you will have an addition to income if you have interest income from non-Arizona municipal bonds. You will have a deduction from income for state tax purposes for social security benefits you receive, and a portion of your income from a U.S. Government and Arizona state or local pension. Arizona taxpayers may take a standard deduction, or itemize. There is one personal exemption allowed per taxpayer, and some may be able to take additional exemptions if there are qualifying dependents. Vehicle Tax
The fee to obtain a driver license is between $10 and $25. You can determine how much it will cost you at the Motor Vehicle Department web site. The fee to register your vehicle is generally less than $10, but there is an additional vehicle license tax (VLT) assessed at the time of registration. This is the equivalent of the personal property tax charged by other states. The more valuable your vehicle, the higher the VLT will be. You can see the formula for the computation here.
You can expect a newer model high end vehicle to have an annual fee of several hundred dollars. Each year that you own the vehicle, the value, of course, will decline, as will the amount of the vehicle license tax you will have to pay.
Gas Tax
in addition to the tax imposed by the federal government, Arizona adds a tax on gasoline that is 18 cents per gallon (2011) for most non-commercial, non-diesel vehicles.
Estate Tax
Since 2005 Arizona has not imposed an estate tax or a gift tax (2011).

Do I need a lawyer?

Hiring a Lawyer
Before you choose a lawyer you may want to do some "comparison shopping" and interview several lawyers. Be sure to ask the lawyer questions such as:

  3. What are your rates and how will the billing be handled?
  4. What is the estimated total expense for costs and fees of my case?
  5. How can we keep the costs and fees down?
  6. What are my alternatives in resolving this matter?
  7. How will you keep me informed of progress and how often will I hear from you?
  8. Who else in your office can I contact about my case?
  9. What documentation do you need from me?
  10. Approximately how long will it take to resolve my case?
In addition to evaluating their expertise and fees, select a lawyer with whom you feel comfortable.
What if I can't afford a lawyer?
Depending on factors such as your income and the kind of legal problem you have, you may be able to get free help for non-criminal cases from Community Legal Services or a Legal Aid organization in your area. For a listing, go to "Low Cost Legal Resources."
If you are accused of committing a crime, you may qualify for free help from your local Public Defender's Office.
How are lawyers paid?
Not all lawyers charge in the same manner. There are several kinds of fee arrangements: hourly, contingency, fixed and retainer.
Hourly Rate
The lawyer charges a set amount per hour for the time spent working on the legal issue. Most lawyers round off their work to the nearest tenth or quarter of an hour. Members of the legal team with less experience generally bill at a lower hourly rate. Ask your lawyer to tell you everyone who is likely to work on your legal matter and their hourly rate. Some lawyers may require a retainer, which is a deposit for fees or services to be incurred. Ask whether any unused portion of the retainer will be refunded.
Contingency Fee
The lawyer agrees to take a specific percentage of the money you receive if you win the case or settle the matter out of court. If the lawyer does not collect any money, the client may not have to pay the lawyer for the time spent working on the case. You will, however, still be responsible to pay all costs and expenses incurred during your case. This type of fee is often used in personal injury cases or other cases when you are suing to collect money from the person or entity responsible for injury or damage. Contingency fees cannot be charged in criminal cases, child custody matters or dissolutions.
Fixed Fee
The lawyer charges a set amount to complete the legal assignment no matter how long it actually takes to do the job. This fee is for routine legal matters such as the preparation of a simple will or filing a bankruptcy. When you agree to a flat fee, be sure you know what it does and does not include and if there could be additional charges.

Retainer Fee
This fee is used to guarantee that a lawyer will be available to take a particular case and could mean the lawyer would have to turn down other cases in order to remain available. A retainer fee can also mean that the lawyer is available to handle your legal issues over a specified period of time. The lawyer must tell you in writing whether the retainer fee is used to hire the lawyer or if it will be used as an "advanced fee" from which he or she will deduct fees as they are earned.
What are fees and costs?
Fees refer only to the money you pay to the lawyer for the time spent by members of the legal team working on your case, whereas costs/expenses are the other charges, such as photocopying, postage, etc., involved in the handling of your legal matter. Your lawyer must provide you a written fee agreement that describes the fees and costs/expenses that you may incur, and how you will be billed.
What can I do to reduce legal expenses?
  • Gather information before meeting your lawyer. Write down names, addresses and telephone numbers of all the people involved in the matter.
  • Be organized. Bring letters, documents and other important papers to your first meeting.
  • Write down questions you want your lawyer to answer.
  • Keep your lawyer informed, but don't make unnecessary calls about minor details. If you are being charged an hourly rate, it is likely you are being charged for your call.
  • Be on time for appointments.
  • Ask if you can reduce costs by obtaining documents, contacting witnesses or providing other assistance.
  • Keep track of all papers sent to you by your lawyer, including receipts for cash payments and monthly billing statements.
What if I have a problem with my lawyer?
If you are not satisfied with the lawyer you selected, you have a number of choices, depending on the problem. Tell your lawyer if you are unhappy with the way he/she is handling your case. Maybe the lawyer is not aware of the problem and is able to work out a solution. If not, you are free to change lawyers, but you probably will have to pay for the work that has already been done by the first lawyer.

Arizona Sales Tax Rates


Effective June 1, 2010 the Arizona sales tax rate for retail purchases is 6.6%. Maricopa County adds on .7% sales tax to support roads and jails. That's a total of 7.3%. Then, each city may add sales tax. If you add the total of the Arizona sales tax and Maricopa County sales tax, 7.3%, to the city sales tax rate, you'll get the total retail sales tax that you'll pay when purchasing merchandise in that city.

Arizona does not charge sales tax on food purchased at retail outlets for home consumption (grocery stores). Cities are allowed to do so, and almost all of them do, with the exception of Mesa and Surprise. The City of Phoenix, which previously did not charge a sales tax on groceries, instituted a 2% tax on those items in April 2010.

When shopping in those cities, be aware of buying grocery items in stores that are not really grocery stores. Their systems might not have the capability to charge a different tax rate for file cabinets as opposed to coffee. Want to fight the battle with them? Often, if someone protests, they will refund the overtaxed portion.

The tax mentioned in this table is the Transaction Privilege Tax, or sales tax, for typical retail items. Taxes charged at restaurants, or for higher priced retail items like cars, may be taxed at a different rate.

There are some cities that are not in Maricopa County that are increasingly being considered part of the Greater Phoenix area. Here is the same information on Phoenix area sales taxes as provided in this article, only in table format, and including a few additional nearby cities.

One more note: The City of Maricopa, part of Apache Junction and part of Queen Creek are in Pinal County, where the county tax rate is higher than in Maricopa County.

In the car insurance world, property damage is defined as damage to your vehicle (car, truck, SUV, etc.). The types of coverage that will pay for damage to your vehicle include collision, comprehensive, and sometimes, depending on the company, uninsured/underinsured motorist.
What You Can Recover
When your car is damaged in an automobile accident and you have coverage, your insurance company will either pay for repairs or “total” your vehicle. When an insurance company totals a vehicle, the vehicle is considered a complete loss and the insured is paid cash value for the vehicle. The actual cash value (ACV) is the cost to replace the vehicle with a vehicle that is of like kind and quality, etc., subtracting an amount that accounts for the totaled vehicle’s depreciation (age and wear and tear).
While it may seem like your car would have to be a complete wreck, a smoking heap, to be deemed totaled, in fact, this determination is made more on the basis of the cost of repair and the car’s worth. A car will be considered totaled if the repair costs exceed a certain percentage of the car’s worth. The percentage will differ from company to company, but usually ranges from 51% to 90%.
What To Do If You Disagree That Your Car is Totaled
Once your car is deemed totaled and you are paid actual cash value for it, your car is taken to a salvage yard where it is auctioned off. Then it is usually chopped up for parts. If you love your car, actual cash value may not seem like an equitable deal to you. When you sign a contract with your insurer, it is agreed between the two of you that the insurer will not have to pay out more than the car is actually worth. But the insurer also agrees to make you whole by placing you in the same spot (relatively speaking) as you would have been without the accident.
If you really want to keep your car, you can take the actual cash value from the insurance company, minus deductibles (in your policy) and minus what the insurer would have gotten at the salvage yard. You can then keep your car and make the repairs yourself. If you decide on this route, let the claims adjuster know right away. Once the car has gone to auction, it is much harder to get it back.
